Survival Isles Terms of Service

These Terms of Service (the "Terms") are an agreement between you and Flowzy for the use of the Survival Isles mobile game, including its online features, virtual items and related services (together, the "Game"). By installing or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.

1. Who can play

The Game is not directed at children under 13. If you are under the age of majority where you live, you may play only with the permission of a parent or guardian who agrees to these Terms for you and is responsible for any purchases made through their store account.

2. Your progress and account

• You can play without an account; your progress is then stored only on your device and is lost if you delete the App or lose the device.
• You may create an optional account (e-mail code, Sign in with Apple or Google) to keep a cloud copy of your progress and restore it on another device. Keep access to your sign-in method; sign-in codes are personal and we will never ask you for them.
• One account per person. Do not share, sell or transfer accounts.
• You can delete your account at any time in Settings → Account → Delete account. Deletion permanently erases your progress and Virtual Items (Section 4) and cannot be undone.

3. Licence

Flowzy grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. The Game is licensed, not sold. You may not copy, modify, distribute, sell or rent any part of the Game, reverse-engineer or extract its code or assets except where the law expressly allows it, or use the Game in a way that breaks the law or these Terms.

4. Virtual items and currencies

• The Game contains virtual currencies (coins, gems and moonshards), virtual items (resources, tools, weapons, armour, structures, outfits, crates) and subscription benefits (the Survivor's Pass). Together these are "Virtual Items".
• Virtual Items are licensed to you for use in the Game only. They have no real-world value, are not your property, cannot be exchanged for money or anything of value outside the Game and cannot be transferred to another person or account.
• Supply crates and raid chests contain random rewards. Their contents can be earned by playing; gems can be used for conveniences such as finishing a crop early or reviving.
• We may change, rebalance or remove Virtual Items as part of running and improving the Game. If we remove a Virtual Item you paid for shortly before its removal, we will try to offer a reasonable replacement.
• Purchases are final and non-refundable except where a refund is required by law or by the refund policy of the store you bought through. Refund requests go to the App Store or Google Play, which processed the payment.
• Virtual Items obtained by cheating, exploiting bugs or breaking these Terms may be removed without compensation.

5. Purchases, Remove Ads and the Survivor's Pass

• All purchases are made through the Apple App Store or Google Play and are subject to their terms, payment methods and refund policies. Prices are shown before you confirm, may differ by country and may change; taxes may apply.
• Remove Ads is a one-time purchase: interstitial ads stop, and optional ad bonuses are granted without watching an ad.
• The Survivor's Pass is an auto-renewing monthly subscription. It renews automatically at the price shown in the store unless you cancel at least 24 hours before the end of the current period; your store account is charged within the 24 hours before renewal. Manage or cancel it in your App Store or Google Play account settings (the Game links there). Cancelling stops future renewals and you keep the benefits until the end of the paid period. Deleting the Game or your account does not cancel the subscription.
• If a free trial or introductory offer is shown, you are charged when it ends unless you cancel before then.
• Restore Purchases (Shop and Settings) re-activates Remove Ads and an active Survivor's Pass on a device signed in to the same store account, and delivers the Starter Pack once to a survivor that has never received it. Gem packs are consumed when delivered and cannot be restored.
• Purchases are delivered to the progress on the device (or account) that made them. Sign in to cloud save if you want to keep them across devices.

6. Advertising

The Game is supported by ads. Rewarded ads are always optional: you choose to watch one in exchange for a stated bonus, and the Game remains fully playable without them. Interstitial ads may appear occasionally when travelling between isles, never in your first sessions and never more than once every few minutes. Ads are provided by Google AdMob under the consent choices described in our Privacy Policy. You may not use tools that block, skip or fake ad views to obtain rewards.

7. Fair play

You agree not to:

• use cheats, bots, scripts, modified clients, memory or save editors, or any tool that automates play or alters the Game's behaviour, data or scores;
• exploit bugs or unintended mechanics (please report them instead);
• submit falsified progress to the leaderboard or otherwise manipulate it;
• interfere with the Game's servers, probe or bypass security, or send abnormal traffic;
• choose a survivor name that is offensive, hateful, sexual, impersonates someone, contains personal information or infringes anyone's rights;
• sell, farm or commercially exploit accounts, Virtual Items or access to the Game.

We use plausibility checks and rate limits on the leaderboard and may remove any entry, reset any board or rename any survivor at our discretion.

8. Leaderboard

Your survivor name, total level, total experience and combat level are visible to other players on the leaderboard. Rankings are for fun and carry no prize unless we announce one in writing.

9. Ownership

The Game, including its software, artwork, characters, names, music, sounds, text and design, is owned by Flowzy or its licensors and protected by intellectual-property laws. Nothing in these Terms transfers any of those rights to you.

10. Availability and changes

The Game and its online features (cloud save, leaderboard, accounts) are a live service that we may update, change, suspend or discontinue. We will try to give reasonable notice (normally at least 30 days, in the Game or on the store listing) before permanently shutting down online features that affect purchased Virtual Items, unless an immediate change is needed for security, legal or technical reasons. Offline play continues to work where the Game allows it.

11. Suspension and termination

You may stop playing and delete your account at any time. We may suspend or end your access to online features, remove Virtual Items, reset leaderboard entries or rename your survivor if we reasonably believe you have broken these Terms, cheated, committed fraud (including chargebacks on legitimate purchases) or created legal risk for us; for minor breaches we will normally warn you first. No refund is owed for Virtual Items or unused subscription time after termination for breach, except where the law requires it. Sections 4, 9, 12, 13, 14 and 15 survive termination.

12. Disclaimers

The Game is provided "as is" and "as available". To the fullest extent permitted by law, Flowzy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Progress stored only on your device can be lost; use cloud save to protect it. Nothing in these Terms limits rights you have as a consumer that cannot be excluded by agreement.

13. Limitation of liability

To the fullest extent permitted by law, Flowzy and its owners, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, revenue or goodwill, arising from the Game or these Terms. Our total liability for all claims relating to the Game is limited to the greater of (a) the amount you paid us through the Game in the twelve months before the claim and (b) EUR 50. These limits do not apply to death or personal injury caused by negligence, fraud, gross negligence or wilful misconduct, or any liability that cannot be limited by law.

14. Indemnity

If you are not a consumer, you agree to indemnify Flowzy against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Game.

15. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates, excluding conflict-of-law rules. Disputes go to the courts of the United Arab Emirates, unless mandatory consumer-protection law gives you the right to bring proceedings in your country of residence, in which case that right is preserved. Before starting formal proceedings, please contact us at support@flowzy.ai; most issues can be resolved quickly.

16. Apple App Store terms

If you obtained the Game from the Apple App Store: these Terms are between you and Flowzy, not Apple, and Apple is not responsible for the Game or its content. Your licence is limited to use on Apple-branded devices you own or control, as permitted by the App Store Usage Rules. Apple has no obligation to provide maintenance or support. If the Game fails to conform to an applicable warranty, you may notify Apple, which will refund the purchase price of the Game (if any); to the maximum extent permitted by law Apple has no other warranty obligation. Flowzy, not Apple, is responsible for claims relating to the Game, including product-liability, legal-compliance, consumer-protection and intellectual-property claims. You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Google Play terms

If you obtained the Game from Google Play, your use is also subject to the Google Play Terms of Service; subscription billing, cancellation and refunds for Google Play purchases are handled by Google under its policies.

18. Changes to these Terms

We may update these Terms, for example for new features or legal requirements. The effective date above will change, and for material changes we will show a notice in the Game. Continuing to play after the effective date means you accept the updated Terms; if you do not agree, stop playing and delete your account.

19. General

If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the Game. These Terms, the Privacy Policy and any rules we publish in the Game are the entire agreement between you and Flowzy about the Game.
